How engagements work

Every engagement covers one situation, with the scope, a fixed fee and a delivery date agreed in writing before work starts. The report and the captures behind it are yours to use as you choose. Nothing you send us is shared outside the engagement, and we return or delete it when the work ends.

Probative

1. Delivery date

If we can’t meet the date your situation needs, we’ll tell you before you agree to anything.

2. What you receive

You get a written report on what the engines say about your company, the sources behind the answers and where they conflict with the public record. Every capture the report relies on comes with it. Where it helps, the report sets out what could be published to correct the record, and where.

3. Who owns it

The report and the captures are yours. We keep a copy only for as long as the engagement letter allows.

4. Confidentiality

Before you share anything confidential, we’ll agree a confidentiality agreement with you. We can work from yours or ours.

5. Working through your counsel

If your counsel engages us, counsel sets the scope, directs the work and receives the report. Whether that makes the work privileged is for your counsel to judge.

6. Working with your advisors

If you already have a communications or investor relations advisor, we’ll work alongside them, and correction work can go through them.

7. Work we turn down

We turn down work that asks for a particular conclusion, would put us on both sides of a dispute at the same time or is aimed at a private individual. We don’t prepare expert reports or evidence for use in any court, agency or other proceeding, or act as expert witnesses.

8. Your material

Nobody outside the firm and the providers named in our privacy policy has access to what you send. It’s stored in Google Workspace and goes into no AI service except Anthropic’s Claude, on an account set so that nothing we send is used for training. We log what we receive and when. When the work ends we return or delete your material, whichever you prefer, and confirm it in writing. If anyone tries to obtain your material or our work for you by subpoena or other legal process, we’ll tell you first unless the law prevents it. Once your material is returned or deleted, we keep only the conflict record, your name and the matter, and, if the engagement letter allows, a copy of the report.

9. After a first conversation

If you want to go further, we confirm the conflict check covers everyone involved, then send an engagement letter with the scope, a fixed fee and a delivery date. Work starts once you’ve signed it.
